3. SMS and Text Messaging Terms & Conditions
Kandu, Inc. and Neurolutions, Inc. offer a mobile messaging program to communicate with customers, patients, and healthcare partners. By providing your phone number and opting into communications via our web forms (including our Digital Intake Questionnaire), you agree to the following SMS terms:

Program Description & User Consent: When you submit your information and agree to receive communications, you agree that Neurolutions, Inc. and Kandu, Inc. may reach out to you to learn more and to receive text messages from or on behalf of Neurolutions, Inc. and Kandu, Inc. at the phone number you provided. These communications primarily regard IpsiHand, your eligibility, and insurance coverage for IpsiHand.

Marketing & Autodialer Disclosure: You acknowledge that these texts may be considered marketing under applicable law and may be sent using an automatic telephone dialing system (an autodialer). Consent is not a condition of purchase.

Alternative Contact Method: If you do not agree to receive these text messages, you can instead call 1-833-813-4774 to learn more about IpsiHand and inquire about eligibility without enrolling in the SMS program.

Message Frequency: Message frequency varies based on user interaction, eligibility status, and service inquiries.

Opt-Out / Unsubscribe: You can cancel the SMS service at any time. Just text STOP to our toll-free number. After you send the SMS message STOP to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time.

Cost: Message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Carrier Liability: Delivery of information and messages to a mobile device may fail due to a variety of circumstances or conditions. Carriers are not liable for delayed or undelivered messages.
4. Intellectual Property
The Service, its proprietary stroke recovery platforms, brain-computer interface (BCI) technologies (including IpsiHand), original content, features, and functionality are and will remain the exclusive property of Kandu, Inc. and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Kandu, Inc.
5. Limitation of Liability
In no event shall Kandu, Inc. or Neurolutions, Inc., nor their directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
1. Your access to or use of or inability to access or use the Service.
2. Any conduct or content of any third party on the Service.
3. Any content obtained from the Service.
4. Unauthorized access, use, or alteration of your transmissions or content.
6. Governing Law
These Terms shall be governed and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions.
